Acceptance of Terms & Conditions of Use and Advertising

You are entering into agreement with ‘Alternative Sale’, by entering into the agreement you are confirming that you have read the terms and conditions and you agree to them.

You agree for Alternative Sale to publish your advert on our website and partner sites.

Your responsibilities

You have the legal right to sell or let the property you are advertising.

The description you provide is true and accurate and is not misleading in any form. Alternative Sale does not take any responsibility for the accuracy of the information or images supplied and can not be liable.

You will pay the advert fee in full, before the advert will be published.

If you have a contract with an Estate Agent you confirm that you have independently checked the contract, in regards to commission. Alternative Sale will not be liable, if it is later found you are legally bound to pay your Estate Agents commission (please see the frequently asked questions, section of this website, where you will find full details of the different types of Estate Agents contracts).

You agree that you fully understand that Alternative Sale acts only as a property advertiser, and will not be involved in negotiation between the buyer and seller and will not assist in setting the market price, or conducting viewings.

You understand that you will need to have in place or will have to arrange a HIPs ( Home Information Pack) for your property. You can find full details in respect of Home information packs under the HIP’s section of this website.

You will inform Alternative Sale as soon as your property has been sold/let or if you no longer wish for your advert to appear on the website, this will enable us to make sure the website is up to date at all times.

Alternative Sale Responsibilities

Your advertisement will appear on Alternative Sale within 12 hours of payment is received, it will remain listed until you tell us that it is sold/let or you wish to remove the property from the website. We will check your advertisement in the first instance to check that the advertiser has complied with the terms and conditions of use and that it is okay for publication. In addition we aim to upload your property onto within 48 hours and if you have chosen to advertise with SWAPHOMES, your advert will also appear with them within 48 hours.

If after 12 months we have not heard from you we will contact you to check you still want the property to be advertised, if we are unable to make contact with you, we may remove the property. 

We will do our best to ensure that the Alternative Sale website is available at all times. We do however reserve the right to take the site offline for upgrades or essential maintenance.

We reserve the right to email you further promotional and marketing offers; you may choose to opt out if you wish.

Limitation of Liability

Alternative Sale will under no circumstances be deemed liable for negligence, breach of contract, loss of data or profit, failure to perform, misrepresentation or otherwise for a direct or indirect loss or damage suffered by you as a result of use or association with our website. Alternative Sale checks the information contained in these pages for accuracy but recommends that professional and legal advise is taken before entering into any form of transaction or contract.

All property listing, and the content described with each advert is based upon information supplied and edited directly by the owner, or on behalf of the owner. These property particulars are displayed in good faith and do not constitute or form part of any contract. Alternative Sale does not take any responsibility for the accuracy of the information contained in these web pages and documents and recommend that all particulars are verified independently prior to entering into any form of transaction or contract.

Alternative Sale is the trading name of Alternative Sale Ltd.

All sellers/Landlords agree and fully accepts Alternative Sale’s liability will under no condition or circumstance ever exceed the advertising fee received.

This website contains links to third party websites that are controlled and maintained by others, Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

Alternative Sale reserve the right to change these Terms and Conditions at any time, and your continued use of the website following any changes shall be deemed to be your acceptance of such a change.

Alternative Sale, offer no guarantee that your property will sell through the use of our website. We make all efforts to ensure your property listing is seen by as many potential buyers as possible.

For Sale/To Let Boards

Please be aware that in some cases a board may be prohibited due to your local council regulations, it is your responsibility to make full enquires and advise Alternative Sale if this is the case, we accept no responsibility here.  In addition you understand that the board is your property and it is your responsibility to remove and expose of the board yourself when you have finished with it.

Refunds

We are confident that you will be happy in your dealings with Alternative Sale, but if for any reason except for if you have found an interested party, we will provide a full refund for the first 24 hours after your advert going live. If you wish to remove your property details after the first 24 hours, no refund will be offered.
